Penal Code 273.5 makes it unlawful to inflict corporal injury on a spouse or co-habitant. Former spouses and co-habitants are covered under this section. Maximum penalties include up to 1 year in county jail if filed as a misdemeanor, or up to 4 years in state prison if charged as a felony. As used in this section, the injury must result in the victim suffering a traumatic condition (i.e., external or internal injury caused by physical force).
Penal Code 243(e)(1) deals with a battery committed upon a spouse or co-habitant. Former spouses and co-habitants are covered under this section. This charge is a misdemeanor carrying the potential for up to 1 year in the county jail and does not require proof of "traumatic condition."
Penal Code 273d covers willful infliction of cruel or inhuman punishment upon a child. Like Penal Code 273.5, this section requires that the injury result in a traumatic condition. Maximum penalties include up to 1 year in county jail if filed as a misdemeanor, or up to 6 years in state prison if considered a felony.
Penal Code 273a covers acts deemed willful harm to a child or child endangerment. This section covers many acts including intentionally causing or permitting a child to suffer unjustifiable pain and suffering or allowing a child's health or safety endangered. Maximum penalties include up to 1 year in county jail if filed as a misdemeanor, or up to 6 years in state prison if charged as a felony.
