As California cracks down on drugs, municipalities face increased pressure to get drugs off the street. As a result, the resources dedicated to pursuing drug offenses has increased in recent years, resulting in a greater number of arrests. According to the California Department of Corrections, nearly 1 out of every 8 prisoners are there for a drug related offense. At the Southern California Legal Group, we have represented clients on a wide range of drug related crimes, including:

Health and Safety Code 11350 deals with possession of a controlled substance such as cocaine, crack, heroin or certain prescription drugs (i.e., Oxycontin). The maximum punishment for an individual convicted under this statute is up to 3 years in state prison.

Health and Safety Code 11357(a) is the possession of any concentrated form of cannabis (hashish). This offense can be a misdemeanor or a felony, punishable by up to 3 years in state prison.

Health and Safety Code 11357(b) is the possession of less than 28.5 grams of marijuana, a misdemeanor or an infraction.

Health and Safety Code 11359 covers possession of marijuana for sale. In every marijuana possession case, should "indicia of sales" such as large quantities of marijuana, money, digital scales, packaging, cell phones, pagers and/or pay/owe sheets (or any combination thereof) be found, it is very likely that the District Attorney will charge possession for sales, punishable by up to 3 years in state prison.

Health and Safety Code 11364 criminalizes possession of paraphernalia for injecting or smoking a controlled substance.

Health and Safety Code 11366 makes it unlawful to maintain a place where controlled substances may be sold or given away. "Maintaining a place," when charged as a misdemeanor carries a maximum sentence of up to 1 year in county jail. If filed as a felony, a defendant may face up to 3 years in state prison.

Health and Safety Code 11377 governs the possession of dangerous drugs, commonly methamphetamine. Depending on the quantity found and whether the accused has suffered prior convictions, this section may be charged as a misdemeanor and carry up to 1 year in county jail, or as a felony, with the defendant facing up to 3 years in state prison.
