Penal Code 647(a) makes it unlawful to solicit or engage in lewd conduct in a place open to the public. Lewd conduct is considered any act that would be considered indecent or offensive. This statutes requires proof that the individual charged with the crime physically touched the private areas of themselves or another for purposes of sexual gratification in a public place where the accused should have known that another person might be present and might be offended by the conduct. Lewd conduct may charged as a misdemeanor or a felony, depending on the circumstances.
Penal Code 314 deals with indecent exposure. A person may be guilty of this offense if s/he exposes themselves for purposes of gratification to another who may be offended by such action. Potential punishment includes having to register as a sex offender and up to 1 year in county jail if filed as a misdemeanor. Indecent exposure may be charged as a felony if it is a second offense, or if the individual has previously been convicted of child molestation.
Penal Code 243.4 covers sexual battery. This statute makes unlawful any non-consensual touching of private part of a restrained individual for sexual gratification or abuse. If charged as a misdemeanor, the maximum punishment is up to 1 year in county jail. If charged as a felony, an individual may face up to 4 years in state prison for this offense.
Penal Code 647(b) criminalizes individuals who solicit or engage in acts of prostitution. Penal Code 653.22 makes it unlawful to loiter in a place for purposes of engaging in prostitution. Prostitution is defined as the act of paying, agreeing, or engaging in sexual activity for compensation. Under the Penal Code, both parties involved in the act (i.e., prostitute and customer) can be prosecuted. Additionally, if a third party "madam" or "pimp" is involved, they may be charged with criminal pandering.
