Penal Code 487 covers grand theft of property. "Grand theft" differs from petty theft in that the value of the property allegedly taken exceeds $400.00. This section may be filed as a misdemeanor or a felony, carrying up to three years in state prison.

Penal Code 666 deals with petty thefts where the accused has a prior theft conviction. Under this section, any person previously convicted of petty, grand or auto theft, burglary, carjacking, robbery, or receiving stolen property (as a felony) who commits petty theft can be punished under this statute. Maximum penalties include up to 1 year in county jail if filed as a misdemeanor, or up to 3 years in state prison if charged as a felony.

Penal Code 496 covers receiving stolen goods and prohibits individuals from buying or receiving property they know to be stolen or from assisting in the concealment of stolen property. Maximum penalties include up to 1 year in county jail if filed as a misdemeanor, or up to 3 years in state prison if charged as a felony.

Penal Code 459 governs residential and commercial burglary. Burglary is commonly defined as the entering of a structure with the intent to commit a theft or any felony therein. First degree burglary occurs when the structure entered is a residence. A felony charge, the maximum punishment for this offense is up to 6 years in state prison. If the burglarized structure is not a residence, the burglary will be second degree. This offense is a wobbler (i.e., alternate misdemeanor or felony), and the maximum penalties include up to 1 year in county jail if filed as a misdemeanor, or up to 3 years in state prison if charged as a felony.
